At the commencement of your services with us you are agreeing to abide by the following policies.

#1 - You will provide 30 days notice subsequent to the billing cycle for any membership changes or cancellations by emailing info@musiciansplayground.com.
For example, if you need a change for August 15th, you’ll want to let us know by July 1st.

This is a sign of respect for your coach and staff and ensures we as a community can plan accordingly.

#2 - Any private lessons cancelled less than 24 hours result in that lesson credit being forfeited.

Your coach needs your commitment to show up during the time you reserve with them so they can deliver as promised.

#3 - Any group classes cancelled less than 4 hours in advance will result in a $10 fee.

This is to ensure it’s easy for those who are serious about taking a class to get a spot and that the coach has adequate time to program for those who will be coming.

#4 - If an additional lesson is taken, you’ll be billed for that lesson separately and in addition to your normal membership rate.

Whether it’s a month with 5 weeks or you’re inspired to try out a new instrument, feel free to go where your interests flow. Just know if it falls outside of your prepaid services, it may be extra.

Full Terms of Agreement

PAYMENT AUTHORIZATION.The Member authorizes his or her bank to make a monthly payment to Musicians Playground by the method indicated on page 2. Member acknowledges and understands that monthly dues to Musicians Playground will be the set amount plus a 3% service fee if applicable, and will be transferred on the 1st day of each month beginning on their first full month of engagement. Should a member join mid-month, the amount will be prorated accordingly.

AUTHORIZATION FOR MUSICIANS PLAYGROUND TO MAINTAIN MEMBER’S PAYMENT INFORMATION.Member authorizes Musicians Playground to keep Member’s credit card or other financial information on file and to post charges to such account for any fees accrued by Member at Musicians Playground. Musicians Playground will provide Member thirty (30) days’ notice via email of any change in its monthly rate. Member acknowledges and understands that this Agreement is contractually binding for the entirety of the duration of their commitment, after which time the contract rolls into a month to month commitment and the Member may terminate this Agreement by providing Musicians Playground with notice of thirty (30) days’ prior to the subsequent contract commitment cycle. MUSICIANS PLAYGROUND MEMBERSHIP CANCELLATION POLICY.If Member decides to cancel their membership with Musicians Playground during their initial commitment of membership specified above, Members agrees that the following Early Termination Fee shall apply: Member shall be charged the difference between the then current month-to-month membership fee and the Member’s monthly membership fee in addition to a one (1) month fee at the then current month-to-month membership fee. Member shall be entitled to use credits (described below) incurred during the month of termination. Should Member not wish to use their credits for the month of termination, Member may either transfer such credits to another Member of Musicians Playground or donate such credits to a charity of Musicians Playground’s choosing. Any credits that remain on Member’s account shall be forfeited upon termination.

PRIVATE LESSON CREDITS & CREDIT USAGE.Member shall receive the agreed upon amount of lesson credits per month. Member must use all lessons within three months of the date they are incurred. For any request of extension of credits, Member shall email such request to info@musiciansplayground.com. The granting or denial of any such credit extension request shall be determined at the sole discretion of Musicians Playground’s Management. If additional services are rendered outside of the scope of the normal agreement, Musicians Playground reserves the right to bill for those services without the consent of the Member once rendered.

PRIVATE LESSON CANCELLATION POLICY.Should Member sign up for private lessons and wish to cancel any particular lesson, Member must provide notice of cancellation via email to info@musciansplayground.com at least twenty-four (24) hours before the scheduled private lesson. Should Member fail to notify Musicians Playground of such cancellation within such time period, Member shall forfeit that particular class’ credit.

GROUP CLASSES CANCELLATION POLICY.Should Member sign up for group classes and wish to cancel his or her attendance at any particular group class for which the Member has signed up, Member must provide notice of cancellation via email to support@musiciansplayground.com at least four (4) hours before the scheduled group class. For every late cancel of a group class (a cancellation made within the four (4) hours before a group class for which Member has signed up to attend), Member shall be charged a one-time TEN U.S. DOLLARS ($10.00) charge for violation of the cancellation policy contained herein.

UPGRADING MEMBERSHIP.A Member may upgrade his or her membership at any time with the prior consent of management, provided Member will be responsible for paying any upgrade fees and for the ongoing payment of any additional monthly fees associated with such upgrade. Should a Member wish to upgrade his or her membership, Member must provide thirty (30) days’ notice to Musicians Playground via email at support@musiciansplayground.com.

DOWNGRADING MEMBERSHIP.A Member may downgrade his or her membership with thirty (30) days’ notice provided via email at info@musiciansplayground.com, however such downgrade shall be charged the difference between the then current month-to-month membership fee and the Member’s monthly membership fee prior to the requested downgrade in addition to a one (1) month fee at the then current month-to-month membership fee. Member shall be entitled to use any credits incurred under their membership plan prior to the downgrade if paid for in accordance with these membership terms and conditions.

MEMBERSHIP FREEZE POLICY.Member may temporarily suspend their membership in accordance with the following terms: (a) Member may freeze their membership once per Member’s (6) month membership for a minimum of one (1) month and a maximum of two (2) consecutive months in one (1) month increments. Member will be charged Musicians Playground current monthly freeze fee. If you freeze your membership during the time of this Agreement, Member will be charged regular monthly dues until Member meets his or her contractual obligation, after which Member will be charged the Musicians Playground current monthly freeze fee for the period of the freeze. If Member has been a member for six (6) months or longer on the day the freeze is effective, Member will be charged the then current freeze fee upfront and billing will be held for the approved duration of the freeze. Freeze fees for the period of the freeze that Member elects are non-refundable, even if Member later reduces the number of months of the freeze of Member’s membership; (b) Member’s freeze request must be done via email by emailing support@musiciansplayground.com; (c) Member may not freeze his or her membership for any reason unless Member’s account is in good standing; and (d) All membership freeze requests must be made in advance. No retroactive membership freezes are permitted.

PHOTO AND VIDEO CONSENT AND RELEASE.Member hereby grants Musicians Playground permission to use Member’s likeness in a photograph, video or other digital media (collectively “Media”) and all of its publications, including web-based publications, without payment or other consideration. Member understands that all media will become the property of Musicians Playground and will not be returned. Member hereby agrees to hold harmless, release and forever discharge Musicians Playground from all claims, demands and causes of action which Member may have by reason of this authorization.

RULES, REGULATIONS AND SCHEDULES.Member agrees to abide by all Musicians Playground rules, regulations and schedules which may be found in this Agreement, online or issued orally, and which may be amended from time to time at the sole discretion of Musicians Playground Management.

VALUABLES AND PERSONAL PROPERTY.Members are urged to avoid bringing valuables to the Musicians Playground premises. Musicians Playground shall not be liable for loss, damage, or theft of personal property of Member, including any and all items left at Musicians Playground.

NO CONSUMPTION OF ALCOHOL IF UNDER THE AGE OF TWENTY-ONE (21).The consumption of alcohol by any individuals under the age of twenty-one (21) is prohibited in the Musicians Playground facilities.

PRICING.After the term of Member’s Agreement has expired, Musicians Playground reserves the right to increase the monthly or annual fee. Should Musicians Playground change the monthly or annual fee, Musicians Playground shall provide thirty (30) days’ notice via email to all Members regarding such pricing changes.

UNPAID BALANCES.Members will not be permitted to access of use Musicians Playground services or facilities until all fees and charges are current. Member is obligated to pay any collection and/or legal costs incurred by Musicians Playground for collection of any fees and/or charges. Musicians Playground reserves the right to charge balances and overdue balances to their current account under the Payment Authorization Section. Further, Musicians Playground reserves the right to charge the credit card or other account identified under the Authorizations Section of this Agreement for the unpaid balance of any goods or services purchased and not paid for in another manner. If any check or credit card charge payable to Musicians Playground is not honored, Musicians Playground Management will assess a TWENTY-FIVE U.S. DOLLARS ($25.00) charge for each check and/or credit card rejected and collect the current and past-due balance in any subsequent month.

GROUP CLASS RULES.Please arrive ten (10) minutes early. Do not enter a class late or leave early unless you give the instructor prior notice. If you are just starting Group Classes or have a pre-existing condition that prevents full participation, please discuss the situation with the Group Class instructor before class. Please be respectful of other members in the Group Class and refrain from interrupting the flow of the class with personal questions, issue or interests. Instructors will allow members to ask questions or voice issues at specific times throughout the class. Personal interests outside of the scope of the class should be explored in private lessons.

MUSIC HOUR AND SPECIAL EVENTS.All sales of Music Hours and special events are final and non-refundable. Music Hour passes and special event passes expire three (3) months from the date of purchase unless indicated otherwise.

NON-MUSICIANS PLAYGROUND INSTRUCTORS.Use of non-Musicians Playground instructors in the Musicians Playground facilities is prohibited.

REVOCATION OF MEMBERSHIP.Musicians Playground reserves the right to revoke and/or cancel this Agreement at any time for any reason in which the Member will receive a refund of all monies paid pursuant to this Agreement no later than fifteen (15) days after such revocation provided that Musicians Playground may retain expenses incurred or the portion of the total price of this Agreement representing the services used or completed, and provided further that Musicians Playground may demand the reasonable cost of goods and services which the Member consumed or wishes to retain after revocation.

LIABILITY WAIVER.In consideration for Member being given access to Musicians Playground, Member hereby releases, waives, discharges and covenants not to sue Musicians Playground, its subsidiaries, DBAs, affiliates, successors, contractors, agents, representatives and/or employees from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or relating to any damage to Member’s property or loss, damage or injury that Member personally sustains, whether caused by the negligence of Musicians Playground or its representatives or not while participating in Musicians Playground programs and/or attending Musicians Playground events regardless of location. Member hereby assumes all risks to Member’s property and Member’s person and in no way, will Musicians Playground be liable to Member for any damages Member sustains.

GOVERNING LAW.This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts.

ENTIRE AGREEMENT.This Agreement, and any accompanying appendices, duplicates, or copies, constitutes the entire agreement between the Parties with respect to the subject matter of this Agreement, and supersedes all prior negotiations, agreements, representations, and understandings of any kind, whether written or oral, between the Parties, preceding the date of this Agreement.
